Gulfstream Ventures LTD Terms of Use

1. This website is owned and operated by Gulfstream Ventures Ltd., carrying on business under the name TedTrips. These terms and conditions under which you may use our website and services offered by us. This website offers visitors the opportunity to purchase Resort accommodations that is discounted in return for attendance at a no-obligation Resort/Travel and Lifestyle Program presentation at the Resort, and on the condition that the visitors meet the required qualifications. By accessing or using the website of our services, you approve that you have read, understood and agree to be bound by these Terms.

2. TedTrips is not a travel agency or a seller of travel. It acts as a promotional or referral agent directly for the resort or hotel.

3. When buying a product from our website, you agree that (i) you are responsible for reading the promotional offer terms in full before making a commitment to purchase it and have determined that you and your family meet the required Certificate stay qualifications that are listed on this website; (ii) you enter into a legally binding contract to purchase the product when you commit to buy it and you complete the checkout payment process. TedTrips provides Special Offers on accommodation packages at selected Resorts and while all care is taken to ensure accuracy of the Offers, we make no warranty as to the advertised product, service or offer other than as described by the advertiser. Please take care n reading the advertisements, descriptions, and conditions before making a purchase. It is your responsibility to ensure that you meet the terms and conditions of the advertised resort and for the promotion/vacation. We cannot refund a customer because of a change of mind. Cancellation fees are likely to be applied by the Resort on any confirmed reservations. TedTrips accepts no responsibility for costs of flights or subsequent losses where a flight is paid prior to confirmation being issued in writing to you. Travel insurance is the responsibility of the customer.  

4. TedTrips does not process final confirmation of stays. All reservations are handled directly by the Resort. We provide a booking system as a convenience between yourself and the Resort.

5. The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available in the terms and conditions of the Special Offers pages and further below in the payments section.

Any additional fees you may incur for the product purchased and any other charges you may incur in connection with the purchase of the product, such as taxes and possible transaction fees, are your responsibility. Where Resort taxes and additional fees are relevant, this is listed upfront in the terms and conditions section of each Resort package. Guests are liable to be charged penalties on site by the relevant Resort company should they fail to attend the agreed Resort presentation.

6. All sales are final once the customer is issued the booking confirmation from the relevant Resort and once the dates of stay are finalized. Guests who wish to change their dates or stay at an alternative Resort may request to do so, but may be charged a fee for doing so. Once payment is made, the guest confirms that they have fully read the terms and conditions of the stay and meets the relevant qualifications. In the event that the guest’s chosen Resort is unavailable on the dates requested, the visitor will be offered an alternative Resort or alternative dates. Once booking confirmation is issued all sales are final.

7.  We may, without prior notice, change the products offered on this site or stop providing particular products; however, bookings that are confirmed, with a booking confirmation issued, will be honoured.  

8. The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the property of TedTrips. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

9.  You agree to indemnify and hold TedTrips harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

10. To the maximum extent permitted by applicable law, in no event shall TedTrips, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

11. To the maximum extent permitted by applicable law, TedTrips assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

12.  We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. You should always read the terms of our Special Offer packages in full before making a purchase, to ensure you qualify for the relevant promotional offer.  When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

13. You agree to receive, from time to time, promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time and we shall unsubscribe you.

14. These Terms, the rights and remedies provided here under, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the Province of Ontario, without respect to its conflict of laws principles.

15. Force Majeure. Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

16. These Terms and Conditions were created on August 15^th, 2024

17.  These terms and conditions form part of the Agreement between the Customer and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Additional Terms and Conditions:

-Client has 12 months from date of purchase of package to use
-Client must be fluent in English or Spanish
-If a traveler cancels or reschedules less than 30 days but more than 7 before arrival date there is an applicable charge of $99 USD
-If a traveler cancels or reschedules less than 7 days but more than 48 hours before arrival date there is an applicable charge of $199 USD
-Client no shows or cancellations within 48 hours of arrival are subject to a charge of $230 USD
-If a client does not attend the presentation, the full rack rate will be charged to the credit card on file at the resort
-Accommodations will be provided for a maximum of Two (2) adults and Two (2) children 12 years of age or under. Children who are over the age of 12 years will be required to make additional payment for the accommodation as an adult.
-Standard Studio Suite only accommodates a maximum of 4 guests
– 2 adults and 2 children under the age of 13

1. Married – One spouse requires age qualification
2. Co-Habitation - Must have ID’s with same address
3. One spouse must have a Passport or Drivers’ License
4. Must have major credit card (MC, VISA, AMEX, DINERS’ CLUB) no debit card
5. At least one partner must be 30 – 75 years of age
6. Combined household income of $50,000 USD (approx. $65,000 Cdn)
